In light of increased enforcement of wage and hour rules by The Department of Labor, resulting in salon shut-downs across Connecticut, the law office of Wiggin and Dana will host a workshop to address employment issues unique to the salon and spa industry.

In this presentation, Wiggin and Dana employment attorney Mary Gambardella will address the potential legal pitfalls of common salon practices, give you guidance as to how you can protect your business from liability for wage and hour violations, and discuss best practices for employment agreements to guard against solicitation of clients and disclosure of other confidential information.

The workshop will be held on March 14, 2016 from 10 a.m. to 12 p.m. at the Delamar Southport Hotel in Southport, Connecticut.

Wiggin and Dana’s website details the effects of the increased government enforcement of labor and employment laws and what the implications are for salon and spa owners.

The website reports: “In 2015, unannounced visits to salons across the State of Connecticut by the Connecticut Department of Labor's Wage and Workplace Standards Division resulted in salons being shut down due to wage and hour violations. In addition, the CT DOL issued substantial fines and recovered owed wages for employees. As these types of unannounced visits are likely to continue into 2016, salon owners and managers need to make sure that their salon's policies are in compliance with federal and state laws in order to avoid a costly shut down and fines.”

In the workshop, attorney Mary Gambardella will provide salon and spa owners and managers with an overview of the employment laws impacting their industry and practical advice to confront any employment issues head on.

  • Drafting of offer letters and employment agreements

  • Commission/compensation arrangements and deductions from wages, including head charges

  • Whether to classify someone as either an employee or an independent contractor

  • How to deal with chair rentals

  • Non-compete, non-disclosure and non-solicitation provisions

  • Guidance on how to prepare for an agency audit, even if the auditor shows up at your door without notice

There will also be time for Q&A.
